The conservative Sebastián Piñera, candidate of the Cambio coalition, won the presidential run-off election in January 2010, ending a 20-year period ruled by the centre-left Concertación coalition. The Economist Intelligence Unit (EIU) believes that there will be no substantial shift in Chile's economic policies under the new president. The EIU expects stimulus policies to be maintained through the middle of the year, permitting economic growth in 2010. Chile jointed the Organisation for Economic Co-operation & Development (OECD) in December 2009; only one other Latin American country, Mexico, is currently a member of the 30-member entity.
Chile’s patent laws are in line with international standards, including TRIPS compliance. Nevertheless, the USTR placed Chile on Priority Watch List in 2009, despite acknowledging improvements. “The United States remained concerned about inadequate protection against unfair commercial use of undisclosed test and other data generated to obtain marketing approval for pharmaceutical products, and urged Chile to provide an effective system to prevent the issuance of marketing approvals for unauthorised copies of patented pharmaceutical products. While some US pharmaceutical companies had reported positive outcomes in patent infringement cases, the underlying weaknesses in Chile’s legal regime require resolution in order for Chile to fully implement its obligations under the FTA.”
Protectionism towards the domestic industry characterises the Chilean pharmaceutical market, which is currently the sixth largest in Latin America. TRIPS-related patent enforcements and health reforms will increase pharmaceutical spending in the long term. Domestic producers lead the pharmacy sector, led by LabChile, Recalcine, Saval and Andrómaco. The leading pharmacy chains have strong vertical distribution systems and practice product & market diversification. Domestic manufacturing is expected to shift from copy products to branded products under licence from multinationals. The domestic industry is heavily reliant on imports of raw materials. Due to a lack of quality standards, exports are slow and mainly restricted to Andean countries.
